Although someone might be weird enough to spend the 40$ to register their work with the USPTO, investigate, and pay lawyers for a cease and desist letters but nonetheless it could happen. Best bet is don't copy anyone unless you have their expressed permission and/or it's in public domain. Copying someone else's idea for the game also gets into a touchy subject and I try to avoid them.
