However, I'm not the one endorsing use of the material which might or might not be covered under copyright law. It would be interesting to really know rather than having folks try to guess or validate why they should use the material. IF you do know for a fact, please state it; an opinion isn't needed.To put it simply, SubSpace* should have been bought off by Electronic Arts in 1998, along with the rest of Virgin Interactive Entertainment's remaining US assets, but it wasn't; leading to the closure of all public servers on December 16th. VIE itself was later bought off by the French publisher Titus Software, which then became Avalon Interactive on July 1, 2003 (two years after Continuum). *At this point in time, VIE was struggling with the cracks being developped which bypassed SubSpace's copyright protection, they kept trying to release patches, but each time a new crack appeared, countering the CD-check. However, Avalon does not possess the rights to SubSpace. When VIE UK was contacted concerning the status of the copyright, it was told that Ozaq2 was managing the remaining VIE US assets. Ozaq2 is a company independant, but also owned by the same person as Digital Brilliant Entertainment (a company that also supports the peer-to-peer file sharing program, Kazaa). During all of that time though, the game remained supported by players and was advanced by PriitK who later encrypted the source into Continuum. Despite the acquisitions, no one has actively pursued the matter concerning the player-run Continuum and servers, which both infringed upon SubSpace's copyright. The SSCouncil had maintained communication with both VIE UK and BDE, whom I strongly doubt were oblivious to Continuum et al., and it sort of became an informal agreement to allow it. Nowadays, Continuum as a whole has diverged quite a bit from the original SubSpace. And although BDE can still claim ownership to a fair part of it, they can't to all of it. If you look at the mug for one, the graphics weren't made by VIE, so BDE can't do anything about it.

Morally it's not right if you're using original SubSpace graphics/content, but as it's been said in the past, nothing will happen. BDE was more in it for the assets rather than the content, and SubSpace just happened to come along with the package. I don't see them getting all hyped up about people selling coffee mugs and suing them, when they have more pressing issues at hand (such as Kazaa getting sued). Just as long as you're not planning to start up your own company and specifically sell original VIE SubSpace artwork to the masses, and make a good amount of revenue off it, you'll be out of the clear.

Lists all the charges/release/etc
